WSJ: After Being Overhyped, RFID Starts to Deliver

On Wednesday, November 7th, 2007, the Wall Street Journal published an article about recent developments in the RFID industry.  The article discusses the substantial amount of venture capital that RFID companies have attracted and the increasingly growing returns that these investments are providing.  According to quoted sources, RFID began with a few applications but now is used in a "wide range of applications on campuses, airports, prisons, semiconductor companies and jet-engine manufacturers."  VentureOne, a Dow Jones research company, reports that from 2002 to 2005, $658 million USD were invested into 70 RFID-related projects by venture capital firms.

California Bans Employers from Requiring RFID Tag Implants

On Thursday, August 30th, the California State Senate passed legislation banning employers from requiring employees to be implanted with RFID tags.  As you might recall, we posted a related article about Citywatch.com, a Cincinnati based security company that operates in California, on July 24th, 2007.  Citywatch.com currently tags specific employees in order to keep classified information secure.  State Senator Joe Simitian (D- Palo Alto), the bill’s sponsor, condemned human tagging as the “ultimate invasion of privacy.”

Seminar to Address RFID Legal and Public Policy Issues

McKenna Long & Aldridge and U.S. trade group Information Technology Association of America (ITAA) will cosponsor an RFID Legal and Public Policy preconference seminar at RFID Journal LIVE! 2007, being held April 30 to May 2 in Orlando, Fla., at Disney's Coronado Springs Resort. During the seminar, scheduled for the afternoon of April 30, leading legal and policy experts will address privacy, data security, government mandates, patent liabilities and other critical issues.

McKenna RFID Webinar

We had a successful Webinar with the RFID Journal last Thursday. We talked to an audience of about 130 about the legal and government relations issues associated with how the RFID industry protects their patents and intellectual property.

Director of the US Patent and Trademark Office's Telecommunications sector spoke eloquently about the explosion in the number of RFID-related patents his office has seen in the last 18 months. He plans to expound more at length about how his office will deal with those patent applications in the future, to gain more institutional knowledge and consistency at the Pre-Conference we are co-hosting with the RFID Journal Live! Conference in Orlando.

MLA Patent law partner Rel Ambrozy offered his insights about how companies should protect themselves against patent litigation. And I tried to offer some info about how Congress is simultaneously looking to change all of the rules on patent reform.

The European Union's Information Society and Media Commission, recently announced their intentions to not regulate RFID for now. The European Commission will instead look to raise awareness of RFID and make sure that citizens are able to make decisions as to how their personal data is used. The EU will be creating a "Stakeholder Group" that includes consumer groups; industry experts, national and European officials to advise the Commission about RFID and it's applications, to facilitate evolving EU policies around RFID.

Over the next two years, the Commission will continue to analyze issues related to spectrum, research and development, standards, privacy and security, intellectual property, environmental impact, interoperability, and neutrality of RFID databases defined by the Commission as the “Internet of Things.”

RFID Pioneer Gets Award From US Department of Commerce

As yet another sign that RFID is attracting the attention of federal policy makers, US Department of Commerce Technology Undersecretary Robert Cresanti on Wednesday gave the first-ever "Recognition of Excellence in Innovation" award to ODIN Technologies of Dulles, Virginia. Patrick J. Sweeney II, President & CEO of ODIN technologies received the award on behalf of the company.

Robert Cresanti also serves as Chief Privacy Officer of the US Department of Commerce and is the Co-Chair of the RFID Interagency Working Group for the Federal government.

Doug Farry to Speak on RFID Privacy and Security Issues

MLA Managing Director Doug Farry will be speaking on August 20th at the Progress and Freedom Foundation's Aspen Summit on electronic privacy and data security issues associated with the use of RFID. He will be part of a panel of distinguished speakers from industry and government; the panel is moderated by former Co-Chair of the Federal Government's Interagency Working Group on RFID, Dan Caprio.

Robert Cresanti To Be in Southern California

US Department of Commerce Undersecretary for Technology, Robert Cresanti, will be in Southern California on August 9, 10 and 11. Robert has identified the development of federal RFID policies as among his top 3 priorities during his services. Robert also serves as Chief Privacy Officer for the Department of Commerce.
